Additional Information
Civil Code Section 1185 Acknowledgement; requisites. The identity of the person making an acknowledgement may no longer be established by personal knowledge alone. Under the new law, the identity of the person making the acknowledgement must be established by specified documents or a credible witness who is personally known to the Notary Public and proves their identity by specified documents, or two credible witnesses with identification are also acceptable forms of identification.
All Valid I.D. Cards must be valid or issued within the last 5 years.
Notarization of Out of State or Out of Country Documents: Notaries are required to use California all-purpose wording when executing an acknowledgement. Should the document not contain “Proper Notarial Wording” the Notary may attach a loose Notarial Certificate at the signer’s request.
A Notary Public may never advise, instruct, or inform the document signer as to what type of notarization is needed. If the document lacks the proper notarial wording, the document signer must be able to communicate what type of notarization they wish to be performed. If they are unsure, it is the signer’s responsibility to contact the document’s receiving agency to determine which type of notarization is necessary.
A Notary Public does not guarantee the truth or accuracy of statements contained in the document to be notarized. The Notary Public is not obligated to verify the document’s contents. The Notary Public cannot advise, instruct or explain the contents of the document(s).
Completing the notarization process assumes the Notary Public has scanned the complete document. A California Notary must refuse to notarize any document that he/she knows to be or suspects to be incomplete or that the Notary knows from experience is incomplete.
Parties signing must understand what they are signing and must be doing so of their own free will.
Disclaimer: Notary Public or any of its agents are not Attorneys. Please contact a licensed attorney or your local bar association for all legal matters.
